This Acceptable Use Policy (“AUP”) describes permitted and prohibited uses of the Services provided by Mail Opened (“we,” “us,” “our”) at https://mailopened.com. This AUP forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.
1) Scope
This AUP applies to all access to and use of our websites, applications, APIs, and related services (collectively, the “Services”) by account holders and anyone interacting with the Services through your account, credentials, or integrations.
2) Prohibited Uses
You may not use the Services to:
Violate any law, regulation, or third-party right (including privacy, security, and intellectual property rights).
Send, facilitate, or track unsolicited or bulk email (“spam”), deceptive or fraudulent messages, or messages without appropriate consent.
Harass, threaten, or promote violence; or target individuals or groups with hateful or discriminatory content.
Upload, transmit, or link to malware, spyware, ransomware, or other malicious code.
Attempt to probe, scan, or test the vulnerability of our systems or networks without written authorization.
Interfere with, disrupt, or degrade the performance or integrity of the Services.
Resell, sublicense, or share access in a manner that circumvents our pricing, features, or intended use.
Misrepresent your identity, affiliation, or message origin; spoof headers or manipulate identifiers.
3) Email Tracking & Consent
Our Service provides tools to embed tracking pixels in emails to measure opens and certain engagement events. You agree to:
Obtain any consents required by applicable law before tracking recipients.
Provide clear notices where required (e.g., privacy policy, email footer) about the use of tracking technologies.
Honor recipient preferences and opt-out requests promptly; remove or disable tracking for recipients who opt out.
Not use the Service to fingerprint, build sensitive profiles, or infer prohibited categories of personal data.
Comply with data protection laws that apply to you (e.g., CAN-SPAM, CASL, GDPR, ePrivacy, CCPA/CPRA, PECR, etc.).
You are responsible for the lawfulness of your email lists, message content, and tracking implementations.
4) Account & Security
You must maintain the confidentiality of access credentials (including access keys, PINs, or tokens) and prevent unauthorized access. Promptly notify us at support@mailopened.com if you suspect compromise. You must not share credentials publicly or embed them in client-side code.
5) Automation, Rate Limits & Fair Use
Use of automation (scripts, bots, or crawlers) must respect our published or implied rate limits and must not impose unreasonable load. We may throttle, rate-limit, or block requests that exceed fair use or degrade service quality for others.
6) API & Integrations
When using APIs or integrations, you must:
Use documented endpoints as intended and comply with any keys, secrets, and scopes issued to you.
Not scrape, reverse-engineer, or attempt to access undocumented features or data.
Store data securely and only for as long as necessary for your stated purpose and legal obligations.
Ensure third-party apps you connect also comply with this AUP.
7) System Integrity & Abuse
You may not bypass technical controls, modify or obscure tracking to deceive recipients, or attempt to access another customer’s data. Activities that attempt to game analytics (e.g., automated opens to inflate metrics) are prohibited.
8) Content Standards
Content delivered or tracked via the Service must not include:
Illegal content, exploitation, or instructions for illegal activities.
Sexually explicit content directed to or involving minors.
Extremist propaganda, incitement to violence, or credible threats.
Intellectual property infringement or violations of confidentiality obligations.
Deceptive, harmful medical or financial claims presented as facts without appropriate disclosures.
9) Legal & Compliance
You are solely responsible for compliance with laws applicable to your use of the Services. Without limitation, this includes anti-spam/anti-malware rules, advertising and consumer-protection laws, export controls, sanctions, and data protection/privacy regulations.
10) Reporting Violations
If you believe this AUP is being violated, please contact us at support@mailopened.com with relevant details (message headers, timestamps, recipient/ sender identifiers, and any supporting logs). We may request additional information to investigate.
11) Enforcement
We may investigate suspected violations and may remove content, disable tracking, rate-limit, suspend features, or suspend/terminate accounts to protect the Service or others. We may report unlawful activity to competent authorities and cooperate with investigations.
12) Suspension & Termination
We may suspend or terminate access for AUP violations, repeated complaints, or risk to the platform, with or without notice as permitted by law and our Terms. Where feasible, we will provide a brief explanation and, at our discretion, a path to remediation.
13) Changes to this AUP
We may update this AUP from time to time. If we make material changes, we will take reasonable steps to notify you (e.g., posting on the site or via email). The “Effective Date” above reflects the latest version.
